Resolution in Support of Student Privacy Protection Act

(approved by the California Democratic Council Statewide Convention in San Bernardino on June 19th, 2005)

Whereas H.R. 551, the “Student Privacy Protection Act” by Representative Honda, amends Section 5928 of the “No Child Left Behind Act of 2001” to allow the release of a secondary school student’s contact information to military recruiters only if the student’s parent provides written consent; and

Whereas a parent should be allowed to “opt in” to the recruiting process rather than being required to “opt out,” since the decision to release the student’s name, home phone number and home address to military recruiters should be a personal one, not a federal requirement; and

Whereas our young men and women should be protected from the abusive and unethical practices used by some military recruiters in an attempt to meet their recruitment quotas;

Therefore Be It Resolved that the California Democratic Council, meeting in annual convention in San Bernardino on June 17–19, 2005, support H.R. 551, the “Student Privacy Protection Act”; and

Be It Further Resolved that copies of this resolution be transmitted to all CDC-affiliated organizations, urging them to actively support H.R. 551, and to all Democratic members of the California Congressional delegation, urging them to support and co–sponsor H.R. 551.
